NexChek Terms of Service Agreement

By clicking “I Agree” or by using the services provided by NexChek ("we", "us", "our"), you ("you", "Customer", "User") agree to comply with and be bound by the following Terms of Service ("Agreement"). If you do not agree to these terms, do not use our services.

1. Free Trial & Subscription Package

• Free Trial: Upon signing up for NexChek, you are granted access to a free trial that allows you to receive 5 background check reports. This trial will be available for a limited time, starting upon successful registration on our platform.

• First Report Charge: Although this is a free trial, please note that you will be charged $19.99 USD for the first background check report. The charge will be applied to the credit card you provide at the time of registration, 1 day after the trial begins, regardless of whether you cancel your trial. By agreeing to these terms, you authorize NexChek to charge $19.99 USD to your submitted payment method.

• Subscription Package: After the free trial, you will automatically be enrolled in a monthly subscription plan. Your subscription plan will include a set number of background checks per month, based on the package you selected during registration. For example, if you sign up for a package that includes 5 background checks per month, you will receive 5 checks each month. Additional checks beyond the allotted amount in your package may incur extra charges at the standard rate.

  • The monthly subscription fee for your selected package is [insert price] USD.

  • You will be billed monthly, and charges will be applied to the payment method you provided at the time of registration.

2. Trial Cancellation & Charges

• 24-Hour Cancellation Window: You have a 24-hour period from the time your free trial begins to cancel the trial. If you do not cancel within 24 hours, your free trial will automatically convert into a paid subscription, and you will be charged the applicable monthly subscription fee as per the package you selected at registration.

• How to Cancel: To cancel your free trial, you must email us at Cancel@NexChek.com within 24 hours of your trial starting. If you fail to cancel within this period, your membership will continue and you will be charged accordingly.

• First Report Charge: Even if you cancel your free trial, you will still be charged $19.99 USD for the first background report. No refunds will be issued for this report, regardless of cancellation.

3. Authorization to Run Background Checks

By providing us with your personal information and submitting a request for a background check, you authorize NexChek to run a background check on you and use the data you submit for that purpose. This may include, but is not limited to, running checks on criminal history, employment history, credit history, and other personal data as deemed necessary for the background check.

You agree that all the information you provide is accurate and up to date. You also acknowledge that you have given us consent to use this information to perform background checks and provide the resulting reports to you.

4. Responsibility for Purchase

• You Are Liable for the Purchase: By purchasing a background check through NexChek, you acknowledge and agree that you are the sole and exclusive party responsible for the purchase. It does not matter who referred you to our platform, whether it be a third party, website, or individual. You are fully responsible for paying for the background check and any subsequent services, and you will not hold any referring party, whether known or unknown, liable for your purchase or subscription fees. NexChek will not be responsible for any third-party referrals or any issues that arise as a result of such referrals.

5. Payment Authorization

• Authorization to Charge: By submitting your payment information, you authorize NexChek to charge the payment method you provide for the first background report (and any additional reports if applicable) in accordance with the pricing stated on our site or as per the agreed terms.

• First Report Charge: Even though you are signing up for a free trial, you will still be charged $19.99 USD for the first background check report, which will be billed 3 days after the trial begins. This charge will be processed to the payment method you provided at registration.

• Subscription Charges: After your free trial period ends, you will be automatically enrolled in a monthly subscription. Your payment method will be charged the monthly subscription fee based on the package you selected.

• Package and Additional Charges: The number of background checks included in your monthly subscription depends on the package you signed up for. If you exceed your allocated number of background checks, additional checks will be billed at the standard rate.

• Trial Cancellation: Even if you cancel your free trial, you will still be charged $19.99 USD for the first background report. No refunds will be issued for this report, regardless of cancellation.

6. No Guarantee of Job Hiring

NexChek provides background checks to help individuals, employers, or organizations assess personal background information, but we make no guarantees regarding the outcome of any hiring process or other decisions related to the use of these background reports. We are not liable for any decisions, employment opportunities, or outcomes that arise from the use of background checks performed through our platform.

7. Limitation of Liability

To the fullest extent permitted by law, NexChek shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from the use of our services or the results of any background checks, including but not limited to the impact on employment, business decisions, or legal actions.

8. Privacy & Data Usage

We value your privacy and are committed to protecting your personal data. By using NexChek, you agree to the collection, use, and processing of your data as outlined in our [Privacy Policy](insert link to Privacy Policy). Please ensure that you read and understand this policy before agreeing to these terms.

9. Modification of Terms

We reserve the right to modify, update, or change these Terms of Service at any time, without prior notice. Any changes will be posted on this page, and by continuing to use our services, you agree to the updated terms.

10. Governing Law & Dispute Resolution

This Agreement will be governed by and construed in accordance with the laws of [State/Country]. Any dispute arising out of or relating to this Agreement shall be subject to the exclusive jurisdiction of the courts in [Jurisdiction], and you consent to the personal jurisdiction of such courts.
